TERMS & CONDITIONS

1. Definitions

1.1 “Webinar” shall mean one or a number of pre-recorded or live presentations, lectures, workshops or seminars that are transmitted over the web using video conferencing software or a streaming service.
1.2 “Exclusive Live Q&A Session” shall mean a question and answer session limited to 50 Webinar Registrants. During the session the Webinar Registrant’s previously-sent question is guaranteed to be answered by Dr. Zahi Hawass.
1.3 “Webinar Registrant” shall mean a customer of Archaeological Paths who has agreed to join the Webinar and/or Exclusive Live Q&A Session.
1.4 “Webinar Organizer” shall mean Archaeological Paths, which is responsible for organizing the Webinar and Exclusive Live Q&A Session.

 

2. Webinar Registrant’s acknowledgment and acceptance of terms

The Webinar Organizer will host a series of Webinars for the Webinar Registrant to attend. The participation is subject to the Webinar Registrant’s compliance with all the terms, conditions, and notices contained or referenced herein (the “Terms & Conditions”), as well as any other written agreement between the Webinar Registrant and the Webinar Organizer. In addition, when using particular services or materials to access the Webinar and/or Exclusive Live Q&A Session, the Webinar Registrant shall comply with any posted guidelines or rules applicable to such services or materials that may contain terms and conditions in addition to those in these Terms & Conditions. All such guidelines or rules are hereby incorporated by reference into these Terms & Conditions. By completing the registration process and/or attending a Webinar, the Webinar Registrant agrees to be bound by these Terms & Conditions.

The Webinar Organizer reserves the right to change Terms & Conditions at any time without notice to the Webinar Registrant. The Webinar Registrant acknowledges and agrees that it is their responsibility to review our website, www.archaeologicalpaths.com (hereinafter the “site”), and these Terms & Conditions periodically and to be aware of any modifications. The Webinar Registrant’s continued use of or viewing of the Webinar and/or Exclusive Live Q&A Session after such modifications will constitute an acknowledgment of the modified Terms & Conditions and agreement to abide and be bound by the modified Terms & Conditions.


3. Description of services

 

The Webinar shall be held and scheduled in accordance with the description provided by the Webinar Organizer. The Webinar will be hosted by Dr. Zahi Hawass. The Webinar will have different themes, but the main focus will remain on the history of ancient Egypt and current research connected to it. The Webinar is scheduled to last for about an hour to two hours.


The Webinar Organizer reserves the sole right to either modify or discontinue the Webinar at any time and notify the Webinar Registrant about those changes at the site. The Webinar Organizer shall not be liable to the Webinar Registrant or any third party should we exercise such right. Modifications  may include, but are not limited to, changes in the pricing structure, the addition of fee-based services, or changes to the format or schedule of the Webinar and/or Exclusive Live Q&A Session. The Webinars Registrant acknowledges that some parts of the Webinar will be pre-recorded and that any changes concerning the format of the Webinar are at the Webinar Organizer’s own discretion. Any new features that augment or enhance the Webinar shall also be subject to these Terms & Conditions.

The Webinar Registrant understands and agrees that temporary interruptions in accessing the Webinar and/or Exclusive Live Q&A Session may occur as normal events. The Webinar Registrant further understands and agrees that the Webinar Organizer has no control over third party networks the Webinar Registrant may access in the course of accessing and viewing the Webinar and/or Exclusive Live Q&A Session, and therefore, delays and disruption of other network transmissions are completely beyond the Webinar Organizer’s control. The Webinar Registrant acknowledges that any changes occurring during the Webinar which may have an impact on the schedule, or the format of the Webinar do not entitle the Webinar Registrant to any refunds.


4. Registration


Registration for the Webinar and/or Exclusive Live Q&A Session will not be considered complete until payment is received and approved. Registration grants the Webinar Registrant access to one Webinar or a number of Webinars and/or Exclusive Live Q&A Session as specified at time of registration. Bookings for the Webinar  and/or Exclusive Live Q&A Session can only be made online through the www.archaeologicalpaths.com website. Bookings by telephone or email shall not be not accepted. A confirmation email will be sent to the Webinar Registrant upon completion of booking and payment. Before the event, the Webinar Registrant will receive an email with the link and login to be able to join the Webinar and/or Exclusive Live Q&A Session. The Webinar and/or Exclusive Live Q&A Session may be accessed only on one device under each individual login. In the event when the Webinar Participant provides a third party with their login details, the Webinar Participant shall be unable to log in for the Webinar and/or Exclusive Live Q&A Session.


5. Requirements for participation in the Webinar and/or Exclusive Live Q&A Session


The participation in the Webinar and/or Exclusive Live Q&A Session may require the Webinar Registrant to configure their settings (audio/video firewalls) on their web-device and computer upon first use, or require the Webinar Registrant to download software for their operating system. The Webinar Registrant may require administrator privileges on their computer to be able to manually install the software.

The Webinar Organizer is not responsible for the Webinar Registrant who fails to download the appropriate software and/or verify their computer configuration or settings before the Webinar and/or Exclusive Live Q&A Session begins. Failure to do so and inability to view the Webinar and/or Exclusive Live Q&A Session is not the responsibility of the Webinar Organizer.

To view the Webinar and/or Exclusive Live Q&A Session on a computer or mobile device, the minimum technical requirements to be met are the following:

Requirements for a PC or a Mac:

Processor (CPU): 2 GHz dual-core processor or better (4-core preferable);
System: Windows 8 (Windows 10 recommended), Mac OS 10.13 (the newest version
recommended), Linux, Chrome OS.
Memory: 2 GB of RAM (4 GB or more recommended);
Browser: The latest official versions of Google Chrome, Mozilla Firefox, Safari, Edge
(Chromium), Yandex, Opera.

Requirements for iOS or Android:

• Android 5.0 or newer
• iOS® 9 or newer
• The latest official versions of Google Chrome or Safari
• Internet connection (WiFi recommended)


Participation in the Webinar and/or Exclusive Live Q&A Session also requires the following:

• Uninterrupted high-speed internet access;
• Adequate bandwidth;
• Email account (to be able to join the Webinar and/or Exclusive Live Q&A Session via
provided online link or ID)

6. Accessibility, registration data, and privacy


The Webinar Registrant is solely responsible for providing, at their own expense, all equipment necessary to access the Webinar and/or Exclusive Live Q&A Session, including a computer and their own internet access (including payment of telephone service fees associated with such access, if applicable).

To access the Webinar and/or Exclusive Live Q&A Session, the Webinar Registrant will be required to click on the link redirecting to the webinar room at clickmeeting.com, or copy the room ID, which consists of 9 digits, and paste it in the appropriate field on ClickMeeting’s website. The Webinar Registrant also has the chance to join the webinar room from their iPad, iPhone, Android device with a mobile app, or browser (Google Chrome or Safari). Both the URL and the ID will be sent to the Webinar Registrant’s email address upon registration.

 

The Webinar Registrant is fully responsible for making sure that they have received their own personal tokens to access the Webinar(s). The Webinar Organizer shall not be liable for the situation in which the automatic email with tokens cannot be successfully delivered to the Webinar Registrant’ email account or goes into the Webinar Registrant’s spam or junk folder resulting in the Webinar Registrant not receiving or being unable to find the email with tokens. In case the Webinar Registrant does not receive the email with tokens upon completing the registration process, they should contact the Webinar Organizer by sending an email to contact@archaeologicalpaths.com maximum 24 hours before the start of the Webinar

Any Registration Data provided by the Webinar Registrant to ClickMeeting is subject to ClickMeeting’s terms and conditions. The Webinar Organizer will not be provided, obtain, use, or disseminate any such Registration Data. The Webinar Organizer expressly disclaims any liability for ClickMeeting’s use of any Registration Data the Webinar Registrant provides to ClickMeeting.

The information provided by the Webinar Registrant while registering for the Webinar and/or Exclusive Live Q&A Session may be used for sending the Webinar Registrant relevant information and updates on the purchased service. It may be also used for sending the Webinar Registrant occasional Archaeological Paths’ news and updates, related product or service information, etc. The provided phone number may be used to contact the Webinar Registrant in regards to relevant information pertaining the purchased service or related product.


7. Fees and payments

The fees for the Webinar and/or Exclusive Live Q&A Session shall be paid at the time of registration and via the link provided on the Webinar Organizer’s site. All fees must be paid in advance of attendance of the Webinar and/or Exclusive Live Q&A Session. Registration for the Webinar and/or Exclusive Live Q&A Session will not be considered complete until payment is received and approved. The Webinar Registrant shall be responsible for the payment of fees of all Webinars and/or Exclusive Live Q&A Session registered to, even if the Webinar Registrant does not attend a purchased Webinar and/or Exclusive Live Q&A Session.

In the event legal action is necessary to collect on balances due, the Webinar Registrant agrees to reimburse the Webinar Organizer for all expenses incurred to recover sums due, including attorney fees and other legal expenses.


8. Cancellations and refunds


Fees for the Webinar and/or Exclusive Live Q&A Session are fully refunded if the Webinar Organizer cancels the Webinar and/or Exclusive Live Q&A Session for any reason. Fees for the Webinar and/or Exclusive Live Q&A Session are non-refundable if the Webinar Organizer modifies or reschedules the Webinar and/or Exclusive Live Q&A Session. The Webinar Registrant agrees that the fees are non-refundable if the Webinar Registrant wishes to cancel the Webinar and/or Exclusive Live Q&A Session or if the Webinar Registrant is not able to attend the Webinar and/or Exclusive Live Q&A Session for which they paid. If the Webinar Organizer determines that the Webinar Registrant must be removed from the Webinar and/or Exclusive Live Q&A Session for inappropriate or illegal conduct, the Webinar Registrant shall not be entitled to a refund.  


9. Participation


The Webinar Registrant’s attendance of the Webinar and/or Exclusive Live Q&A Session is subject to all applicable laws and regulations. The Webinar Organizer has the right at our sole discretion to remove any content or Webinar Registrant(s) from the Webinar, in our judgment, does not comply with these Terms & Conditions. The Webinar Organizer is not responsible for any failure or delay in removing such content. The Webinar Registrant accepts that during the Webinar they will not be able to interact with the host or Dr. Zahi Hawass neither through a chat tool nor video chat.

At the end of each Webinar there will be a Q&A session, during which Dr. Zahi Hawass will be answering some questions sent earlier by Webinar Registrants to contact@archaeologicalpaths.com. The set of questions which Dr. Zahi Hawass will be answering will be previously selected by the Webinar Organizer, who shall not be liable toward the Webinar Registrant if their question(s) is not answered during the Webinar. This does not apply to the Exclusive Live Q&A Session (strictly limited to 50 people) during which the Webinar Registrant’s question is guaranteed to be answered by Dr. Zahi Hawass provided it does comply with our Terms and Conditions.

The Webinar Registrant agrees that the Webinar Organizer may at any time, and at the Webinar Organizer’s sole discretion, terminate their access to the Webinar without prior notice for violating any of the above provisions. In addition, the Webinar Registrant acknowledges that the Webinar Organizer will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in investigating suspected criminal violations.


10. Participation in the Exclusive Live Q&A Session


The Exclusive Live Q&A Session with Dr. Zahi Hawass shall be limited to 50 participants and last for approximately one to two hours. The Webinar Registrant will have a chance to ask Dr. Zahi Hawass one question. The Webinar Registrant’s question shall be send to the Webinar Organizer’s email address no later than 24 hours before the start of the Exclusive Live Q&A Session and shall consist of maximum 300 characters (with spaces) in order to be answered by Dr. Zahi Hawass. Otherwise, the question may not be presented to Dr. Zahi Hawass and consequently not answered. The Webinar Organizer reserves the right to modify the Webinar Registrant’s question without changing its meaning.


The Webinar Registrant’s question is guaranteed to be answered by Dr. Zahi Hawass provided that the Webinar Registrant fulfils all the requirements described above. In case when the Webinar Registrant’s question is not answered, the Webinar Registrant shall be eligible for a refund for the Exclusive Live Q&A Session. In case when the Webinar Registrant’s question is not answered due to the Webinar Registrant’s failure in fulfilling the requirements described above, the Webinar Registrant shall not be eligible for a refund. Moreover, the Webinar Registrant's failure to ask the question on time does not qualify for a refund. The Webinar Organizer reserves the right to ask a question of The Webinar Registrant during other webinars as well. The Webinar Registrant accepts that during the Webinar they will not be able to interact with the host or Dr. Zahi Hawass neither through a chat tool nor video chat.


11. Ownership of intellectual property


The Webinar Organizer’s Webinars and Exclusive Live Q&A Session accommodate content which includes without limitation images, illustrations, designs, icons, photographs, video clips, sounds, text, data and other materials displayed or available on the Webinar Organizer’s Webinar (the "content") that is protected by copyright, trademark, trade dress, and/or other proprietary rights of the Webinar Organizer. You agree to comply with any and all restrictions regarding use of the content.

The Webinar Organizer is not responsible for the content of the Webinars and Exclusive Live Q&A Session provided by third parties, thus they shall not be liable for the accuracy, veracity, legality of the information, documentation, opinions or any other content provided by the speaker or included in the Webinars and Exclusive Live Q&A Session.


12. Use of materials


No content from the Webinars may be copied, republished, uploaded, or otherwise distributed. The Webinar Registrant may not sublicense, transfer or otherwise make available any content to any third party for commercial purposes or financial gain or use the content in any other media or in any location. The Webinar Registrant is not permitted to review or display this content in a group environment or setting (conference room, etc.) in a manner that will permit individuals without a valid license to access or view the material. If an individual is viewing the Webinar or Webinars without previous complete registration, their unauthorized access permits the Webinar Organizer to seek immediate legal action. The Webinar Registrant may not alter or modify the content in any way without written permission of the Webinar Organizer (Archaeological Paths). Failure to comply with these Terms and Conditions, which make it illegal to distribute or share any content from the Webinar(s), shall result in the Webinar Organizer taking appropriate legal actions to remove such content. The Webinar Registrant agrees to reimburse the Webinar Organizer for any legal costs and any other costs connected to removing illegally distributed content from the internet or any other source. The Webinar Organizer shall also be financially compensated by the Webinar Registrant for copyright infringement and illegal distribution of the content belonging to the Webinar Organizer.

The Webinar Registrant understands and agrees that their use of the Webinar and/or Exclusive Live Q&A Session is at their own risk. The Webinar Registrant shall be responsible for protecting the confidentiality of their password(s). The Webinar Organizer shall not be held responsible for the lack of access to any Webinar and/or Exclusive Live Q&A Session if the Webinar Registrant grants the access details to a third and unauthorized party and thus shall not be able to participate in the Webinar and/or Exclusive Live Q&A Session.


13. General disclaimer and limitation of liability


Neither the Webinar Organizer nor its third parties make any representations that the continuing materials and educational materials contained in the Webinars and/or Exclusive Live Q&A Session are appropriate or authorized for use by all states or any other professional membership or credentialing organizations. If the Webinar Registrant chooses to access the Webinars and/or Exclusive Live Q&A Session, it is done so on the Webinar Registrant’s own initiative and the Webinar Registrant is responsible for compliance with all applicable laws. The Webinar Registrant shall be held responsible if any part of the Webinar and/or Exclusive Live Q&A Session or Webinar’s and/or Exclusive Live Q&A Session’s communication content shall be distributed in any form or in any way without the Webinar Organizer’s written permission.

The Webinar Organizer shall not be held responsible for any third party regulations and actions, or fitness of the Webinars’ and Exclusive Live Q&A Session’s content with the Webinar Registrant’s beliefs, religion, cultural heritage, knowledge and assumptions, or technical and streaming problems, or accuracy and completeness of responses during the Webinar and/or Exclusive Live Q&A Session or content of and materials available during the Webinar and/or Exclusive Live Q&A Session and any other variables not included in this agreement. The Webinar Organizer makes no warranty regarding the accuracy of the licensed materials and assumes no obligation to update any of the licensed materials or any information contained therein.

 

14. Amendments

 

The Webinar Organizer reserves the right to amend the Terms and Conditions at any time. All amended Terms and Conditions shall automatically be effective upon being posted by the Webinar Organizer on the website. The Webinar Organizer is exempt from the obligation to send updates on the amendments.
