Agreement to Terms & Conditions

Registration Form is a written agreement which is concluded between travel agency Archaeological Paths Grzegorz Poplawski, NIP: PL5871688611 (hereinafter referred to as the ‘Tour Organizer’) and a tour guest (hereinafter referred to as the ‘Traveler’). The agreement affects a tour organized by the Tour Organizer for the Traveler. The Traveler confirms that all the personal information provided on this Registration Form is correct.

 

Tour price: $9985 per person in a double room (2 people sharing). If you are traveling alone, you can share a room with another tour member. If you would like to have a single room, the single supplement costs $2985.

 

Payment Schedule:
- Deposit is only $1200 during booking
- Full payment is due 90 days before the tour

 

Price Includes: Dr. Zahi Hawass’ participation; 5-star accommodation (6 nights in 5-star hotels in Giza/Cairo and 7 nights onboard a 5-star deluxe Nile cruise ship); domestic airfare during the tour (roundtrip Cairo to Luxor); 3 meals a day – (13 breakfasts, 12 lunches, 13 dinners); all sightseeing tours and entries included in the itinerary; bottled water during sightseeing; English-speaking Egyptology expert as a tour guide; English-speaking travel concierge; transfers in air-conditioned buses; reception at Cairo International Airport; airport transfers on standard arrival and departure days; government taxes; basic health insurance; government’s permission to enter sites that are limited or closed to the public as stated in the itinerary.

 

Not Included: International airfare (we can assist you with the booking); $25 entry visa (issued and paid in cash on arrival at Cairo International Airport); tips; alcoholic beverages; personal expenses.

 

Travel Documents: All travelers need a passport valid for at least six months after the date of departure from Egypt.

 

Reservation and Payment: The deposit is required at the time of booking. Upon receipt of the deposit, the Tour Organizer gives the Traveler the right to change the tour date once without additional costs providing that the changes are confirmed up to 365 days before the first day of the initial tour date. The final payment is due 90 days prior to the beginning of the tour. The Tour Organizer shall prepare a tour update before the final payment with accommodation upgrade options and additional services if available for the Traveler’s tour. It is the responsibility of the Traveler to determine that final payment reaches the Tour Organizer on time. Payments are to be made by credit card or wire transfer. The credit card payments incur an additional and non-refundable fee of 3.9% that will be added to the total net amount of the Traveler’s payment. For the wire transfer option, any fees are to be covered by the Traveler.

 

Standard Cancellation and Refund Policy*: The deposit and full payment for the tour is fully refunded if the Tour Organizer cancels the tour for any reason. If the Traveler cancels the reservation or any component thereof, the Traveler is required to file the cancellation request via e-mail to contact@archaeologicalpaths.com. If the Traveler cancels the tour, the deposit is non-refundable. Tour cancellation requests received within 91 days prior to the initial tour date are subject to the following charges:

More than 91 days – loss of the deposit payment

90 – 75 days prior to the initial tour date: 50% of the total tour price per person;

74 – 60 days prior to the initial tour date: 75% of the total tour price per person;

59 – 0 days prior to the initial tour date or nonappearance: 100% of the total tour price per person.

The costs of any supplements purchased are included into the total price of the tour. In case of reimbursement of any costs paid to the Traveler, all bank charges or credit cards are to be covered by the Traveler. During the tour no refund shall be made for transfers, sightseeing tours, unused site entries or any other services (including meals, accommodation, or transportation) voluntarily not taken. The Tour Organizer reserves the right to cancel any tour prior to departure in which case the Traveler will be provided with two options: a) 100% refund of all net payments made, b) tour date change without any additional costs or penalties. The Tour Organizer is not responsible for any costs incurred by the Traveler (e.g. advance airline tickets and travel insurance). Any complaints and refund inquiries must be made by the Traveler in writing within 30 days after the end of the tour. Complaints and refund inquiries shall be considered by the Tour Organizer within 30 days from the date of the inquiry. The complaints and refund inquiries sent in later than 30 days after the end of the tour will not be considered by the Tour Organizer.

 

*COVID-19 Cancellation and Refund Policy (Worry-Free Policy)
The policy applies to registrations made from 09/15/2020, and it is valid until 12/31/2021.

In case of cancellation or rescheduling the tour until 12/31/2021 and due to reasons described in the Worry-Free Policy following terms and conditions apply to the Traveler’s reservation. Otherwise, Standard Cancellation and Refund Policy, as described above, applies to the Traveler’s reservation.

  • The Traveler may reschedule the tour up to 91 days prior to the Traveler’s initial tour date for any reason.
  • The Traveler may reschedule the tour from 90 days up to 24 hours before the initial tour date, if: a) international flights to the Traveler’s country of travel are not available or cancelled with alternative routing unavailable making it impossible for the Traveler to reach the destination, b) the Traveler has well-founded medical concerns that are supported by medical documents from the Traveler’s doctor and which confirm that the Traveler’s health state prevents them from traveling on the scheduled tour due to COVID-19.
  • The Traveler may cancel or reschedule the tour at any time prior to the departure, providing that the country of travel has: a) closed its borders, b) introduced mandatory quarantine for arriving tourists. Points a) and b) apply only if any of the above-mentioned travel restrictions is in force during the scheduled tour.

The Traveler may change the date of the tour to one of the dates available at that time. In case of rescheduling the tour due to any of the reasons described in the Worry-Free Policy all funds paid by the Traveler shall be transferred to a newly selected tour and be kept as a deposit, which – in case of tour cancelation made by the Traveler – shall remain non-refundable. In the event of the tour cancellation made by the Tour Organizer, already transferred funds may be transferred again to another tour date selected by the Traveler without the possibility of a refund.

 

General Data Protection Regulation (GDPR) clause: Here at Archaeological Paths we take your privacy seriously and will only use your personal information (entered in Registration Form and email messages by yourself and passed to our company during telephone conversations with our consultants) to administer your tour and to provide the tour services you have requested from us. All the personal data is processed by our head office employees, however we have the obligation to pass your details but only onto the parties directly connected with organizing the tour you have chosen. We are required under the European Union tax law to keep your basic personal data (name, address, contact details) for a minimum of 5 years after which time it will be destroyed. However, we would like to use your name and email address to inform you of our future tours and similar services. This information is not shared with any other companies nor used for any other purposes. You can request an access to, rectification or erasure of your data at any time. The Tour Organizer makes sure to keep your personal information safe and that it is only to be accessed by the Tour Organizer’s approved personnel. If you wish to raise a complaint on how we have handled your personal data, you can contact our Data Protection Officer Michal Zoltko at michal@archaeologicalpaths.com who will investigate the matter. If you think that the provided information is not used in accordance with the GDPR, you can also contact the entity authorized to conduct proceedings in the matter of implementation of the General Data Protection Regulation: Biuro Generalnego Inspektora Danych Osobowych, ul. Stawki 2, 00-193 Warszawa, Poland

 

Responsibility: The Traveler is responsible for obtaining all documents such as valid passport, visas, travel or medical certificates and any other documents as well as getting any vaccines required by a country of travel at the time of travel to participate in the Tour. Any extra costs incurred for rerouting due to travel without the necessary documents will be the Traveler’s responsibility. The Tour Organizer is not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, government actions, weather, natural disasters, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time, any delay or cancellation that causes you to miss all or any portion of the tour. The Traveler releases the Tour Organizer from, and agrees not to sue or make claim against the Tour Organizer for, property damage, cancellation of any excursions for any reason, illness, negligent rescue operations or procedures, personal injury, or death arising out of the participation in the any activities during the Tour, and any activity related thereto, including transportation to and from the site of the attractions, regardless of whether such property damage, illness, personal injury, or death results from the negligence of the Tour Organizer (but not its reckless, willful, or fraudulent conduct), and/or from any defect in equipment. If the Traveler decides to participate in activities including, but not limited to, any excursions involving animals, riding on animals, hot air ballooning, climbing and any other activity which the Tour Organizer considers to carry inherent risk of serious illness, injury or death then the Traveler fully understands and acknowledges that activities carry with them various inherent risks, including serious illness, injury or death and the Traveler takes complete responsibility for their own health and safety and agrees to assume all risks of injury, illness or death, whether foreseen or unforeseen, that may befall the Traveler as a result of participating in any activities and agrees to release the Tour Organizer and its affiliates, their agents, employees and representatives from any liability whatsoever related thereto. The Tour Organizer is not responsible for any services which do not form part of the agreement. This includes, for example, any additional services or facilities which the hotel or any other supplier agrees to provide for the Traveler where the services or facilities are not advertised by the Tour Organizer as forming part of the Tour and the Tour Organizer has not agreed to arrange them as part of the agreement. The Traveler fully understands that the travel experience may differ depending on individual goals and expectations. The Tour Organizer will not be bound by, or liable for, any description, photograph, representation or warranty made by or provided by the Tour Organizer’s any promotional materials. The itineraries and staff presented in the promotional materials are subject to modification and change by the Tour Organizer. Every effort will be made to operate Tour and its itinerary as planned, but alterations may still occur after final itineraries have been prepared. The Tour Organizer reserves the right to change the itinerary or trip features at any time and for any reason, with or without notice, and the Tour Organizer shall not be liable for any loss of any kind as a result of any such changes. The Tour Organizer reserves the right to substitute hotels or attractions. In the event of a change of accommodation, the Tour Organizer guarantees the 5-star standard. In case of exclusion of the given attraction, visit or a meeting from the itinerary, the Tour Organizer reserves the right to cancel such a visit and replace it with another site/attraction. The changes contained in this paragraph do not apply to the absence of Dr. Zahi Hawass on the tour which would entitle the Traveler to cancelation of the tour without any penalties.

 

Roommates: Single Travelers may choose to share a room with another tour participant during the Tour. In such case the Tour Organizer will try to find a roommate for the single Traveler. If the Tour Organizer is unable to find a roommate for the Traveler, then the Traveler will not need to pay for the single supplement and the cost of it will be covered by the Tour Organizer. In case of add-on tours and additional nights at the hotel, the Traveler shall purchase the single supplement if there are no other single travelers willing to share a room with another participant. If the Traveler who has already been assigned to a shared room with another participant before, during or after standard tour and then decides to purchase the single supplement for himself/herself shall also purchase the single supplement for the traveler he/she was paired with to share the room at the beginning. The cost of the single room supplement shall be in accordance with the terms and conditions applying at the time of requested change.

 

Health Insurance: The Tour Organizer shall purchase health insurance for the Traveler from AXA Insurance Company. The Insurance purchased by the Tour Organizer shall cover the insured amounts as specified below, not including chronic diseases or pre-existing conditions. There is a possibility to extend the health insurance, that is increasing the insurance amounts and adding insurance covering chronic diseases and pre-existing conditions by contacting the Tour Organizer. „I declare that I and all tour participants for whose tour I will make payments, have received General Terms and Conditions of KONTYNENTY Travel Insurance before signing this agreement. The General Terms and Conditions of KONTYNENTY Travel Insurance are approved by the AXA’s Board of Directors in resolution no. 1/17/12/2015 from December 17th, 2015 and along with the other terms of the insurance contract will apply after TOUR AGENCY concludes the insurance contract on my and other tour participants’ behalf. I also affirm that I and the mentioned participants accept all the travel insurance conditions. I and all tour participants for whose tour I will make payments, agree to the processing of our personal data specified in the insurance Application by AXA Insurance and Reinsurance Company S.A. The data will be processed in accordance with the Personal Data Protection Act, in order to conclude and execute the insurance contract on my and the mentioned tour participants’ behalf. I affirm that I provide the personal data voluntarily and I know I have the right to check and modify it."
